Does Botswana have a Data Privacy Law?
Yes, Botswana has a data privacy law. Data privacy if protected in Section 9 of the Botswana
Constitution. Moreover, the Data Protection Act, 2018 (“DPA”) 2018 was passed with the main
purpose of regulate the protection of personal data and to protect the right of privacy of individuals.
The DPA sets out various bases and principles for the lawful processing of personal information,
establishes a Data Protection Commissioner, which is responsible for enforcing the DPA, creates
thresholds for the processing of sensitive data and lays out various rights of data subjects.
